Reading Your Portuguese Lease

Clauses to look for — and to push back on — before signing.

Why this matters

Portuguese tenancy law (NRAU) is broadly tenant-friendly, but only if your lease doesn't contract around it. Many template leases include clauses that are unenforceable but will still cost you time and money to fight. Read every line before you sign.

Term and renewal

Most leases are 1 year with automatic renewal for equal periods unless one side gives notice.

  • Tenant exit: by law you can leave a 1-year+ lease after 6 months with 60 days' written notice
  • Landlord refusal of renewal: only allowed in narrow legal cases (own use, major works) with at least 120 days' notice
  • Watch for clauses that try to lock you in for the full term with penalties — ask the landlord to delete or align with NRAU

Deposit and rent rules

Deposit (caução) is normally 1–2 months and must be returned within 30 days of move-out, less documented damages with photos and quotes. Annual rent increases are capped each year by a government coefficient (typically 2–6%); anything above is unenforceable, and the landlord must give 30 days' written notice before applying it.

Who pays what

Lease should specify clearly who handles each cost.

  • IMI (annual property tax) — always the landlord
  • Condomínio (HOA) — usually the landlord, but some leases push it to the tenant; clarify
  • Water, electricity, gas, internet — typically the tenant in their own name
  • Building insurance — the landlord; contents insurance is your call (~€80–€150/year)
  • Small repairs (under €100) — typically the tenant; structural repairs the landlord

Things worth negotiating

Most landlords will move on at least one of these if you ask politely in writing before signing:

  • Fresh paint at move-in
  • Replacement of any broken or worn appliances
  • Inclusion of (or carve-out from) the condomínio fee
  • A clause clarifying that ordinary wear and tear is not deducted from the deposit
  • Permission to install a wall-mounted TV or shelves
  • Pet acceptance (in writing, with any conditions)

Registration and the recibo

Your landlord must register the lease with Finanças within 30 days and issue you a monthly recibo de renda (rent receipt) electronically. Without it you can't claim rent on your IRS return and you have weaker legal standing if there's a dispute. If receipts don't appear after the second month, raise it in writing.

Signing day

Sign two originals (one each), exchange copies of IDs, and confirm the IBAN to which rent will be paid. Pay the first month's rent and deposit by traceable transfer. Get the keys, the building access cards, the boiler manual, and the previous month's utility bills if available.
